Sounds right. It's more an ethical issue. Ask first, is my advice.

Right. Participants in this list do receive, when they sign up, a "Welcome
to the list" message that explains rules, netiquette, etc. In it I simply
state that if you agree to participate in the list by posting a message,
you give me the right to "re-publish" those words in a "permanent" archive.
(It's on the online-news Web site at
http://www.social.com/social/hypermail/news/index.html as well as in monthly
compiled files that can be retrieved with an e-mail command sent to
Majordomo.) Other than that, I have no rights to what's posted.

Agreed.

I don't go that far. I believe when you have posted a message to a public
list or newsgroup, you've "published" your words -- thus, you shouldn't be
surprised if they show up elsewhere. An ethical journalist will ask for
permission, not just for courtesy's sake but also to confirm that the
words are indeed written by the person on the From: line of the post.

Sometimes people post words hastily that they later regret. (Perhaps some
of the recent sniping about Top 10 Lists falls into this category. ;) On
occasion you might find someone refusing permission on these grounds.
Actually, this topic has been well covered on this list (but not for a
while). Anyone interested could search the list archive and find previous
discussions.
