No, no. 
One, you have to "subscribe", that is to say "I will", "I express 
a clear intention to", accepting the conditions of the list owner. 
Two, Listserv or Majordomo, or anything alike, (you have to pay for
them) is a side-service of a private provider (not the Net's, like 
Usenet).

This can be a problem, so Steve should write a warning note like this: "The 
written materials in this archive are intended for personal, private use only.
Any different use is subjected to a written consent of the author, a quote
of the name of the author and the citation of the source:
"http://www.planetarynews.com".

Well, this is a totally different matter and not of little evidence.
A Listserv o a Majordomo demon can be easily hacked. But, you teach 
me, hacking is a crime. In the meanwhile many major software 
companies/universities invented the so called "spiders", some Net 
demons working round the clock, 365 days a year to collect "HTML page
headers" throughout the Internet. More recently, they invented 
different kind of "spiders" that are able to collect other types of 
informations from Pop servers or News servers. That is to say they 
are, somehow, "hacking the Net" but in a acceptable way: they just give
you an e-mail address, or the result of a search in the public domain.
Were the same thing done on a Listserv, it should be PURE HACKING. 
I.e. a crime.
